The Constitution Party, Green Party, No Labels Party, Justice for All Party, and the We the People Party are no longer recognized parties in NC. These parties did not receive two percent of the entire vote cast as required by § 163-96 (a)(1), which resulted in their termination pursuant to § 163-97.
The State Election Information Management System will be updated in May to reflect the removal of the parties, according to 08 NCAC 01 .0107. Existing voter’s records will be updated automatically by the NC State Board of Elections in June 2025.
§ 163-96. "Political party" defined; creation of new party.
(a) Definition. - A political party within the meaning of the election laws of this State shall be one of the following:
(1) Any group of voters which, at the last preceding general State election, polled for its candidate for Governor, or for presidential electors, at least two percent (2%) of the entire vote cast in the State for Governor or for presidential electors.
§ 163-97. Termination of status as political party.
When any political party fails to meet the test set forth in G.S. 163-96(a)(1), it shall cease to be a political party within the meaning of the primary and general election laws and all other provisions of this Subchapter. 08 NCAC 01 .0107 POLITICAL PARTY FORMATION, TERMINATION, AND REINSTATEMENT
(a) Pursuant to G.S. 163-97, a political party ceases to be a political party on the date the State Board certifies the general State election in which the political party failed to poll for its candidate for Governor, or for presidential electors, at least two percent of the entire vote cast in the State for Governor or for presidential electors. Any voter registration form received after that date by a county board of elections where the applicant chooses to affiliate with an expired political party shall be registered as "unaffiliated," except that if the person is already registered to vote in the county and that person's registration already contains a party affiliation, the county board of elections shall not change the registrant's political party affiliation.
